Welcome to Storm Door Pro, LLC ("Storm Door Pro," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our storm door replacement services (the "Services"), our website (if applicable), and our communications with you. By engaging our Services, you agree to be bound by these Terms.

1. Services Storm Door Pro, LLC provides storm door measurement, sales, and installation services. Our process typically involves: a. Initial contact, often via a web form on our Shopify store. b. Follow-up communication by an AI phone agent or AI text agent to schedule a measurement appointment. You may also interact with a human representative if requested. c. An on-site visit by a service member to take measurements. d. Customer selection of a storm door. e. Ordering of the selected door. f. Scheduling and completion of the door installation at your premises.
2. Quotes and Orders a. Quotes for storm doors and installation are provided after measurements are taken and a door selection is made. b. An order is confirmed once you approve the quote and complete the payment as outlined in Section 3.
3. Payment Terms a. Full payment for the storm door and installation services is due at the time the door is ordered by you. b. We accept payments through our Shopify store, including Visa, Mastercard, American Express, PayPal, Apple Pay, and other methods as indicated on the payment page. c. All transactions are processed securely.
4. Refund Policy a. Once a door is ordered and payment is made, no monetary refunds will be issued. b. If you wish to change your order after payment but before installation, you may be able to select an alternative door of equivalent or different value, subject to agreement with Storm Door Pro, LLC, and any applicable price adjustments.
5. Appointments, Cancellations, and Rescheduling a. Scheduling: Appointments for measurements and installations are scheduled and confirmed via phone (AI or human agent) or text message (AI agent). b. Customer Cancellation/Rescheduling of Measurement Appointment: You may reschedule a measurement appointment without a fee by contacting us. We request that you provide as much notice as possible. c. Customer Cancellation/Rescheduling of Installation Appointment: If you need to cancel or reschedule an installation appointment after the door has been ordered, we will attempt to reschedule it within the same month. If rescheduling within the month is not possible, or if repeated rescheduling occurs, we may need to arrange for later delivery and installation, or you may be required to reorder a door, potentially incurring additional costs. d. Company Cancellation/Rescheduling: If Storm Door Pro, LLC needs to reschedule a measurement or installation appointment, we will provide you with the earliest possible notice via text, call, or email and will work with you to find a suitable new appointment time.
6. Warranties a. Storm Door Pro, LLC passes along any manufacturer warranties applicable to the storm doors we install (e.g., from Andersen). We will provide you with the relevant manufacturer warranty documentation. b. Storm Door Pro, LLC provides a warranty for its workmanship for a period of [Specify Your Workmanship Warranty Period, e.g., one (1) year] from the date of installation, covering defects in the installation service itself. This workmanship warranty does not cover issues arising from misuse, abuse, lack of maintenance, normal wear and tear, or acts of God.
7. Customer Responsibilities While Storm Door Pro, LLC aims to make the process as seamless as possible, you are responsible for ensuring clear access to the work area on the day of measurement and installation.
8. SMS Text Messaging and Phone Communications By providing your phone number and consenting, you agree to receive communications from Storm Door Pro, LLC, including via AI phone agents, AI text agents, and human representatives. These communications may be made using an automated telephone dialing system or pre-recorded messages.
a. **Consent:** When you provide your phone number and check the opt-in box on our web form which states, "By checking this box, I agree to receive account notifications, marketing, and promotional SMS messages from Storm Door Pro, LLC. I understand that these may be sent using an automated system, and that message and data rates may apply. Reply STOP to opt out, HELP for help. Consent is not a condition of purchase," you consent to receive: i. **Account Notifications:** Messages regarding your quotes, appointments (confirmations, reminders, updates), service status, payments, and other transactional information related to your engagement with us. These are sent as needed based on your service status. ii. **Customer Care Messages:** Messages to assist with your service, such as technician arrival notifications or completion confirmations. These are sent as needed. iii. **Marketing and Promotional Messages:** Messages about our services, special offers, or promotions. Marketing message frequency will vary. If you engage in a text conversation with our AI agent, you will receive responses to your messages. If you do not respond, you may receive follow-up messages approximately a few times on the first day of contact, two times on the second day, once on the fourth day, once on the seventh day, and then up to two reminder messages per week thereafter for a limited period or until you opt-out. b. **Opt-Out:** You can opt-out of receiving SMS messages at any time by: i. Replying "STOP" to any text message you receive from us. ii. Requesting to be added to our do-not-text list by speaking with one of our AI phone agents or human representatives. c. **Help:** For help regarding SMS messages, reply "HELP" to any text message. You will receive a response stating: "Storm Door Pro Support: For help call 617-245-0988 or email [Your Support Email Address - PLEASE PROVIDE THIS]. Reply STOP to unsubscribe. Msg&Data rates may apply." d. **Message and Data Rates:** Message and data rates may apply to any messages sent or received in connection with our SMS communications. Storm Door Pro, LLC is not responsible for any charges from your mobile carrier. e. **Carrier Non-Liability:** Carriers are not liable for delayed or undelivered messages. f. **Confirmation of Opt-Out:** If you opt-out, we may send you one final message to confirm your decision.
9. Limitation of Liability To the fullest extent permitted by law, Storm Door Pro, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Services; (b) any conduct or content of any third party on the Services; or (c) unauthorized access, use, or alteration of your transmissions or content. In no event shall Storm Door Pro, LLC's aggregate liability for all claims relating to the Services exceed the amount paid by you to Storm Door Pro, LLC for the specific Services from which the claim arose.
10. Indemnification You agree to defend, indemnify, and hold harmless Storm Door Pro, LLC, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.
11. Governing Law These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles.
12. Dispute Resolution a. Informal Negotiation: The parties agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Services informally by contacting each other. Mediation: If the dispute is not resolved through informal negotiation within thirty (30) days, the parties agree to attempt to resolve the dispute through mediation with a mutually agreed-upon mediator in Middlesex County, Massachusetts. Costs of mediation shall be shared equally by the parties. c. Binding Arbitration: If the dispute is not resolved through mediation within sixty (60) days of initiating mediation (or such other period as the parties may agree), the dispute shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules (or Commercial Arbitration Rules, if applicable) then in effect. The arbitration shall take place in Newton, Massachusetts. The arbitrator's decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. d. Exceptions: Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
13. Changes to Terms We reserve the right to modify these Terms at any time. If we make changes, we will post the revised Terms and update the "Last Updated" date. Your continued use of our Services after such changes constitutes your acceptance of the new Terms.
